AG Merrick Garland Names Special Prosecutor to Investigate Hunter Biden Case

Weeks after Hunter Biden’s plea deal on tax and gun charges fell apart in court, Attorney General Merrick Garland has designated Delaware U.S. Attorney David Weiss as a special counsel to investigate the case. Weiss, who has been overseeing an inquiry into possible tax and financial crimes involving Hunter Biden since 2018, requested to be appointed as a special counsel, and Garland agreed it was in the public interest to do so.

Hunter Biden is also a central figure in congressional investigations into President Biden’s alleged involvement in his family’s foreign business deals and alleged influence peddling. The investigations have implications for Biden’s presidency and his 2024 reelection campaign.

The appointment of Weiss as a special counsel comes just weeks before he was scheduled to testify before the House Judiciary Committee about the now-cancelled plea agreement. The deal would have spared Hunter Biden felony charges and jail time for tax evasion and lying on a gun background check form. It would have also shielded him from future prosecution for alleged foreign lobbying and other related crimes.

The move to elevate Weiss’ role to a special counsel indicates that there may be additional criminal charges against Hunter Biden, including potential violations of the Foreign Agent Registration Act. Recent testimony, bank records, and emails suggest that Hunter Biden earned millions of dollars working for foreign companies seeking his father’s assistance.

However, Hunter Biden’s attorney maintains that his client committed no wrongdoing outside of Delaware. The judge handling the case has asked both parties to resolve the plea deal dispute.

Former President Donald Trump criticized the request for a California trial, suggesting it raises questions about the newly appointed special counsel’s independence. Mr. Weiss was nominated by Trump in 2017 and confirmed by the Senate in 2018.

As a special counsel, Weiss will have the authority to bring criminal charges in any jurisdiction, not just Delaware. He will also have greater autonomy in decision-making and will be required to release a report of his findings when the investigation is completed.

This appointment marks the third special counsel appointed by Garland since he assumed the role of Attorney General in 2021.
